১১। তালিকাভুক্তি বাতিল—
(১) প্রত্যেক তালিকাভুক্ত ব্যক্তি নিম্নবর্ণিত কারণে তাহার টার্নওভার কর তালিকাভুক্তি বাতিলের জন্য সংশ্লিষ্ট কর্মকর্তার নিকট নির্ধারিত সময়সীমা, শর্ত ও পদ্ধতিতে, আবেদন করিতে পারিবেন, যথা:
(ক) যদি তিনি অর্থনৈতিক কার্যক্রম পরিচালনা বন্ধ করেন;
(খ) যদি তাহার অর্থনৈতিক কার্যক্রমের টার্নওভার পর পর তিনটি কর মেয়াদে আনুপাতিক হারে তালিকাভুক্তি সীমার নিম্নে থাকে।
(২) সংশ্লিষ্ট কর্মকর্ত নির্ধারিত সময়সীমা, শর্ত ও পদ্ধতিতে, উক্ত ব্যক্তির তালিকাভুক্তি বাতিল করিতে পারিবেন।
(৩) মূসক নিবন্ধনের জন্য দাখিলকৃত আবেদন তালিকাভুক্তি বাতিলের আবেদন হিসাবে বিবেচিত হইবে এবং সংশ্লিষ্ট কর্মকর্তা যে তারিখে মূসক নিবন্ধন সনদপত্র ইস্যু করিবেন সেই তারিখের অব্যবহিত পূর্ববর্তী দিবসে টার্নওভার কর তালিকাভুক্তি বাতিল হইয়াছে বলিয়া গণ্য হইবে।
(৪) যদি কোন ব্যক্তি তালিকাভুক্তি বাতিলের জন্য উপ-ধারা (১) এর অধীন আবেদন না করেন, তাহা হইলে সংশ্লিষ্ট কর্মকর্তা নির্ধারিত সময়সীমা ও পদ্ধতিতে, উক্ত ব্যক্তির তালিকাভুক্তি বাতিল করিয়া প্রয়োজনীয় আদেশ প্রদান করিতে পারিবেন।
11. Cancellation of enlistment.—
(1) Every enlisted person may make‚ within such time, on such terms and in such manner as may be prescribed, an application to the Commissioner an application for the cancellation of an enlistment for the following reasons‚ namely—
(a) if he ceases to carry on any economic activity;
(b) if the turnover of his economic activity remains below the enlistment threshold proportionately for three consecutive tax periods.
(2) The Commissioner may, within such time, on such terms and in such manner as may be prescribed, cancel the enlistment of such person.
(3) An application for VAT registration shall be treated as an application for the cancellation of an enlistment‚ and the enlistment as a turnover taxpayer shall be deemed to have been cancelled on the date immediately before the date on which the Commissioner issues the VAT registration certificate.
(4) If any person does not make an application under sub-section (1) for the cancellation of enlistment‚ the Commissioner may pass necessary orders after cancelling the enlistment of such person within such time, and in such manner as may be prescribed.
